Michele Falconieri is the Partner in charge of the Commercial Solutions, Dispute Resolutions and Litigation work group at wilson/ryan/grose lawyers. Michele became a Partner of the Firm in 2011 and has more than 15 years of experience across commercial, dispute resolution, restructuring, insolvency and litigation areas of law.

As an active member in the business community Michele is currently the Deputy President of the Chamber of Commerce and a member of the Australian Institute of Company Directors.

While experienced in both reviewing and drafting contracts and advocating and enforcing client’s rights, Michele’s wide range of experience in commercial transactions gives him proficiency in delivering well considered and practical advice on the most suitable means for dispute resolution, mediation, arbitration and litigation services as required, while keeping in mind the real advantages to clients that can be achieved by commercial outcomes.

In addition to providing the traditional commercial litigation and insolvency legal services, Michele identified a desire and need by both corporate and individual clients to achieve more commercial solutions to problems rather than endure and incur the risk and expense associated with litigation.

The Commercial Solutions department has been formed to provide the following services for clients:

  • Assessment of Risk and advise on mitigation strategies for Corporate, Partnership and other Business entities.
  • Advise on risk mitigation & personal liabilities and obligations for officers and executives.
  • Advise and assist with compliance and defences available to directors under the Corporations Act
  • Assistance with implementing strategies, agreements and documents to avoid ambiguity and reduce instances of costly disputes.
  •  Develop and implement internal agreements and procedures for informal dispute resolution.
  •  Assistance to ensure compliance with legislation and good governance practices.
  •  Offer advisory services for directors, committees and board members.

Experience includes

  • Taking complex circumstances and identifying novel and commercial resolutions and solutions to avoid litigation or insolvency
  • Negotiation of settlements,
  • Making and responding to claims,
  • Making and responding to applications for adjudication,
  • Enforcing and appealing decisions through the courts and Tribunals.
