New Enduring Power of Attorney and Advance Health Directive Forms Introduced

The Queensland Government has introduced new rules and forms for Enduring Powers of Attorney and Advance Health Directives under the Powers of Attorney Act 1998 (Qld).
These new rules commence on 30 November 2020, and any enduring documents made on or after this date will need to use the new forms. The new forms are not to be used until the commencement date (i.e. any enduring documents made before 30 November must continue to use the existing forms).
Provided they have been correctly executed, existing Queensland Enduring Powers of Attorney and Advance Health Directives will retain their validity even after the new forms have commenced.
These new forms come amidst a host of other changes to Queensland’s guardianship legislation, details of which we will share in further ebulletins in the coming weeks.
