Update: Body Corporate and Community Management Legislative Reform Delayed
11th December 2018
Those of us who are involved in the strata title world, including committee members, unit owners and strata title professionals, have been eagerly awaiting the outcome of a report into potential changes to the body corporate legislation for some time. We will unfortunately have to wait a little longer.
The Commercial and Property Law Research Centre of QUT carried out an extensive legislative review in 2017 which resulted in a report with 64 recommendations of proposed amendment to the Body Corporate and Community Management Act 1997 and its regulations. The Queensland public, who were invited to have their say, made more than 200 submissions which were taken into account in the report.
Recently, the Attorney General of Queensland, Yvette D’Ath extended the expiry of the body corporate regulations to August 2019 on the basis that the review is not likely to be finalised before then.
We will continue to ‘watch this space’ and will keep you updated with respect to these much awaited reforms.
In the meantime, if you would like more information on the proposed reforms themselves, or on any other matter relating to community titles schemes or body corporate law, be sure to contact Maxine Fenlon, David Patton or another member of our Property Law team at our Townsville or Sunshine Coast offices.
